Terms of Service

1. Acceptance of Terms

By accessing or using any of the products and services operated by Obsidian IT Consulting SRL (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not accept these terms, please do not use the Services.

The Services are operated by Obsidian IT Consulting SRL, a company registered in Belgium.

2. Service Description

Obsidian IT Consulting operates a range of software products and online services, which may include web applications, browser extensions, and APIs. The specific features and scope of each product are described on that product's own website or within the product itself. A single account may give you access to several of our products; these Terms apply to your account and to every product you access with it.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

3. User Account

3.1 Account Creation

To use certain features of the Services, you must create an account. You agree to:

  • Provide accurate and complete information
  • Be at least 16 years old
  • Maintain only one account per person
  • Keep your login credentials confidential

3.2 Account Security

You are responsible for maintaining the confidentiality of your account and API key. You agree to notify us immediately of any unauthorized use of your account at al@obsidian-it.be.

3.3 Account Deletion

You may delete your account at any time through the dashboard settings. Upon deletion, your data will be permanently removed in accordance with our Privacy Policy. Inactive accounts are automatically deleted after 1 year of inactivity.

4. Subscription and Payments

4.1 Free and Paid Tiers

Our Services offer both free and paid subscription tiers. The features available in each tier are described on the relevant product's website. We reserve the right to modify pricing and features with reasonable notice.

4.2 Payment Processing

Payments are processed by our payment partner, Polar. By subscribing, you also agree to Polar's terms of service. All fees are non-refundable except as required by applicable law.

4.3 Cancellation

You may cancel your subscription at any time. Your access to paid features will continue until the end of your current billing period.

5. Acceptable Use

You agree NOT to:

  • Use the Services for any illegal purpose
  • Violate the terms of any third-party platform you access through the Services
  • Attempt to reverse engineer, decompile, or disassemble any part of the Services
  • Share your API keys with others or use multiple accounts to circumvent limits
  • Use automated tools to abuse the Services or bypass rate limits
  • Harass, stalk, or harm others using information obtained through the Services
  • Use the Services for mass data scraping beyond permitted use
  • Interfere with or disrupt the Services' infrastructure

6. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, and source code, are the exclusive property of Obsidian IT Consulting SRL and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

7. Third-Party Services

Some of our Services integrate with or rely on third-party platforms. Where a product interacts with a third-party platform, your use must comply with that platform's own terms. Unless explicitly stated, we are not affiliated with, endorsed by, or sponsored by any third party, and our products are independent tools that work with publicly available data.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RESULTS OBTAINED FROM THE SERVICES WILL BE ACCURATE OR RELIABLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBSIDIAN IT CONSULTING SRL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Obsidian IT Consulting SRL, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

13. Governing Law

These Terms are governed by the laws of Belgium. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Belgium.

For EU consumers: Nothing in these Terms affects your statutory rights under mandatory consumer protection laws in your country of residence.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
